Deep-linking: To link or not?

MSNBC: To link or not to link?

"Most of the court cases and legal threats have been over a form of hypertext-connecting called deep-linking, by which you simply connect users to a specific page rather than a site’s home page"

What's the point of the Internet if no "deep-linking" is allowed? Hello...? Should I write in my blog that "MSNBC has an article on deep linking today - good luck finding it"?? I don't think so - those corporate lawyers must be fairly clueless... My own weather pages have used "deep linking" since 1995/96 and they keep doing so without any complaints...
